Because there is “no reasonable likelihood of conviction,” Brady Kiser, the husband of parenting guru Emilie Kiser, will not be charged in connection with his son’s drowning in May, authorities announced Friday.
“I am grateful to law enforcement and the county attorney for conducting a thorough investigation and confirming that this was a tragic accident,” stated Brady Kiser’s attorney.

When three-year-old Trigg drowned in the family’s backyard pool, Brady Kiser was at home with his two sons. After his father discovered him asleep in the water, the youngster passed away six days later.
In a search warrant document that Phoenix’s NBC station KPNX was able to obtain, Brady Kiser claimed that when his toddler wandered outdoors, he was preoccupied with his baby boy. Brady Kiser reported to authorities that he called 911 after finding his son unresponsive in the pool.

Earlier this month, the Chandler Police Department recommended that Brady Kiser be prosecuted with one count of child abuse after submitting the case to the Maricopa County Attorney’s Office for consideration.
Surveillance footage from the house “showed how the drowning occurred and the actual timeline of events,” according to the county’s attorney’s office, although it did not elaborate.
The prosecution must demonstrate that the defendant “failed to perceive a substantial and unjustifiable risk, and that failure to perceive the risk was a gross deviation from the standard of care a reasonable person would show” in order to prove child abuse, according to a statement made by Maricopa County Attorney Rachel Mitchell.
Mitchell stated that this case did not meet the criteria of a “reasonable likelihood of conviction,” which is used to analyze cases.
